Purchase and service terms
This is a translation. If the language versions differ, the Swedish version applies. Show the Swedish original
Applies to purchases in a physical shop after a free reservation via the website or app, to bicycle service and to the processing of personal data. For partner shops, each shop is the seller and service provider when this is stated at booking.
PART A | PURCHASE TERMS FOR CONSUMERS
1. Seller and scope
When you buy directly from Cykel PRO, the seller is Cykel PRO Malmö AB, company registration number 559575-2162, Kalendegatan 13, 211 35 Malmö, info@cykelpro.se, +46 79 310 10 44. The platform may also show goods and workshop services from independent partner shops. For a reservation or booking with a partner shop, the expressly stated partner shop is the contracting party and the responsible seller/service provider; it is shown with company name, company registration number and contact details before the customer continues. The platform's liability under mandatory law is not affected by this description.
2. Reservation via the website or app – not a distance purchase
You can ask, free of charge, for an available item to be set aside at the chosen shop. The reservation involves no obligation to buy and no payment through the website or the app. No binding order or contract for the purchase of goods is entered into through the reservation flow. The customer can cancel the reservation free of charge at any time before purchase. Only on site in the shop does the customer have the opportunity to check the item, accept the purchase and pay; the purchase contract is entered into there.
3. Reservation period, pickup and availability
Normally, the reservation is valid for 48 hours from when the shop has confirmed it. The customer is informed of the end date and time. On request, the shop can extend the reservation to a maximum of 72 hours in total; the extension applies only once the shop has confirmed it. If the item is not picked up or the reservation is not extended, the item is released for sale. The reservation is free of charge. If, for special reasons, the confirmed stock level turns out to be wrong, the shop shall contact the customer without delay and offer cancellation or an alternative; the customer is not obliged to buy a replacement item.
4. Prices, businesses and payment
Prices for consumers are stated in SEK including VAT and mandatory fees. Logged-in, verified business buyers may have separate business prices and are clearly informed about any VAT/prices excluding VAT before the purchase. The price at reservation is stated clearly. The confirmed reservation price normally applies within the validity period of the reservation, subject to obvious errors under applicable law. Payment for goods takes place only in the physical shop when the purchase is completed, using the means of payment displayed by the respective shop. No payment through the web or app takes place for purchases of goods. A receipt is provided in a suitable way, and a digital copy may be made available in the customer account if the service supports this.
5. No voluntary right of withdrawal for in-shop purchases
For purchases agreed and completed in a physical shop, Cykel PRO does not voluntarily offer open purchase or a right of exchange due to a change of mind. This does not limit the right to complain about defects, warranty commitments or any right of withdrawal that may follow from mandatory law if, in an individual case, a contract has actually been concluded at a distance or off-premises. The fact that the customer pays or picks up in the shop is not in itself enough to exclude a statutory right of withdrawal.
6. Complaints about defective goods
The consumer's rights follow the Swedish Consumer Sales Act (konsumentköplagen, 2022:260). A defect in goods can be complained about within three years in accordance with the rules of the Act. A complaint must be made within a reasonable time after the defect was noticed or should have been noticed; within two months of discovery is always considered to be in time. For defects that appear within two years of delivery, the statutory presumption of an original defect applies, with statutory exceptions. The customer may request repair or replacement in accordance with the law. The shop may offer repair as a first practical solution but does not take away the customer's options under the law. Price reductions, cancellation of the purchase and damages are assessed under the law. Approved complaints are remedied free of charge, within a reasonable time and without significant inconvenience. The customer can contact the relevant seller via the stated contact channels and should describe the defect and preferably attach the receipt/other proof of purchase, photos and frame number; the lack of an original receipt does not in itself exclude statutory rights.
7. Wear, accidents, incorrect use and inspection
Normal wear and damage actually caused by external impact, accident, incorrect use, an incorrect charger or lack of maintenance is not automatically an original defect. The cause shall be assessed individually; reduced battery capacity and wear on brakes, tyres or chain may be due to normal use but may also be due to a defect covered by the law. A workshop assessment is documented and the law's rules of evidence are followed. An inspection fee for a consumer complaint may never be charged as a standard practice contrary to law; in particular, during the first two years a fee should normally not be charged. After this period, a reasonable inspection fee, communicated in advance, may in some cases apply when the shop is not responsible for the defect. The customer shall be informed before any chargeable fault-finding begins.
8. Manufacturer's warranty
Any manufacturer's warranty is voluntary and applies according to the warrantor's special terms. It supplements and never limits the statutory right to complain about defects. Cykel PRO does not give any separate warranty of its own beyond what is expressly stated for a particular item. Always contact the seller stated on the receipt when making a complaint; the right to complain applies against the seller even if there is a manufacturer's warranty.
9. Used goods and product information
If used or refurbished products are sold, their condition, known faults, degree of use, condition description and price shall be stated correctly before purchase. Statutory consumer rights also apply to used goods, taking into account agreed and clearly disclosed characteristics. Bicycle/electrical system/battery should have a documented status and applicable safety instructions.
10. Delayed delivery or deviation
For a purchase actually entered into, delay, deviation from the contract, complaints, refunds and any damage are handled under applicable mandatory law. For a free reservation only, the customer can cancel without a fee. The shop notifies the customer when the item is ready for pickup.
11. Discounts, campaigns and loyalty
Campaign terms, duration, any limit on quantity and the customer category the offer applies to shall be shown before purchase. For an advertised price reduction, the previous lowest price during the relevant 30 days is stated in accordance with the price information rules, where applicable. Bonus points do not give an automatic cash claim; rules for earning, use, reversal on a cancelled purchase and period of validity are presented separately for each current offer.
12. Disputes and law
First contact the seller to resolve the dispute. Consumers can contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), www.arn.se, under the authority's applicable conditions and value limits, as well as a competent court. Swedish law applies, subject to mandatory international consumer protection rules.
13. Changes
The terms in force when the contract is entered into apply to that particular purchase. Future changes to the terms may not retroactively restrict the consumer's rights. The version and date of entry into force are shown clearly.
PART B | WORKSHOP AND SERVICE TERMS
1. Booking and time of contract
The customer can send a booking request via the website or app. Confirmation of a time slot does not in itself mean a contract for a specific repair; such work is agreed separately with the stated workshop. If a binding distance contract is nevertheless concluded, mandatory rules apply on, among other things, information and the right of withdrawal. No advance payment is required for a standard booking.
2. Drop-off record and safety
At drop-off, the bicycle's identification/frame number where applicable, the described problems, visible damage, accessories and the agreed assignment are documented. The workshop may recommend that the customer does not use an unsafe bicycle until the fault has been remedied. Personal data and images are handled in accordance with the privacy policy.
3. Professional workmanship, price and additional work
The work is carried out in a professional manner in accordance with the Swedish Consumer Services Act (konsumenttjänstlagen, 1985:716). An agreed fixed price applies according to the agreement; for an approximate price indication, the final price may normally not exceed the indication by more than 15 per cent under the law, with applicable exceptions. If additional work is needed, the customer is first contacted for consultation and price approval; statutory exceptions for certain necessary measures may occur. On request, the customer receives an itemised invoice. Payment is made in the shop when the work is finished and the bicycle is picked up, unless otherwise expressly and lawfully agreed.
4. Cancellation and missed appointment
A booked appointment can be cancelled free of charge before the workshop has started work, unless otherwise lawfully agreed. If there is a binding service contract and the customer cancels during ongoing work, the workshop may be entitled to compensation under the Consumer Services Act for work performed and certain costs. No automatic cancellation fee is charged without valid grounds.
5. Defects in the service, delay and complaints
The customer can complain about faulty workshop work under the Consumer Services Act and claim legal remedies, for example remedy, price reduction, cancellation and compensation when the conditions are met. For work on movable property such as a bicycle, the complaint period is normally three years. In the event of delay, the rights under the law apply, including the right to demand that the service be completed and the possibility of withholding the relevant payment. The workshop shall investigate and respond within a reasonable time.
6. Collection and storage
When a bicycle is ready for collection, the workshop contacts the customer through the contact channels provided. Any storage costs, measures in the event of non-collection and the workshop's liability are assessed under applicable law and what the parties have validly agreed. The workshop does not sell or dispose of the customer's bicycle without legal grounds.
7. E-bikes and batteries
The manufacturers' instructions and applicable safety requirements are followed. Batteries with visible damage or a safety risk may need to be handled separately. Service measures and any limitations for particular electrical systems shall be communicated in advance. Safety rules may not be used to override the consumer's statutory right to complain about defects.
